The Colorado Divorce Process

A Colorado dissolution of marriage generally begins with a petition filed by one spouse or jointly by both spouses. At least one spouse must ordinarily have lived in Colorado for 91 days immediately before filing. Because Colorado is a no-fault divorce state, the court can enter a decree after finding that the marriage is irretrievably broken.

For Greenwood Village residents, divorce and family law cases proceed through the Arapahoe County District Court in Colorado’s 18th Judicial District. We guide clients through the petition, service, required financial disclosures, negotiations, mediation when required, contested hearings, and the final decree of dissolution.

Service & Response Deadlines

A divorce generally can’t be finalized until at least 91 days after the petition is served or the spouses file jointly. This statutory waiting period doesn’t predict how long a particular case may take. A spouse served in Colorado generally has 21 days to respond, while service outside the state generally provides 35 days.

Financial disclosures give both parties information about income, assets, debts, and expenses before settlement discussions or court decisions. We help clients prepare for this process and for temporary orders hearings, which can address issues requiring court direction while the case remains pending.

Negotiation, Mediation & Court Hearings

Disputed issues may be addressed through negotiation, mediation, arbitration, or litigation. In mediation, a neutral third party helps the spouses work toward an agreement but doesn’t decide the dispute. Unresolved issues may proceed to a contested hearing before a judge.

We explain the available dispute-resolution paths and prepare clients for family law court proceedings. The appropriate course depends on the issues, the parties’ ability to reach agreements, and applicable court requirements.

Filing Fees, Property Rules & Parenting Jurisdiction

Arapahoe County District Court filing fees are approximately $230 for a dissolution petition, whether or not children are involved. Court fees can change and are separate from attorney fees. Individuals who qualify may request a filing-fee waiver from the court.

Colorado applies equitable distribution rather than community-property rules when dividing assets. The court considers the circumstances and financial evidence when determining a fair division. Legal separation addresses many of the same property, support, and parenting questions as divorce, but it doesn’t end the marriage.

When minor children are involved, jurisdiction is another threshold issue. Subject to applicable rules and exceptions, Colorado generally requires a child to have lived in the state for at least 182 consecutive days before its courts make an initial custody determination. A parenting plan can then address parental responsibilities, decision-making authority, and parenting time.
